   In accordance with Section 551.042 of the Texas Government Code, this agenda has been posted at the Weatherford City Hall, distributed to the appropriate news media, and posted on the City website at http://www.weatherfordtx.gov within the required time frame. As a courtesy, the entire Agenda Packet has also been posted on the City of Weatherford website at www.weatherfordtx.gov/agendas. All meetings of the Weatherford City Council, Municipal Utility Board, and other boards/commissions/committees of the City of Weatherford are open to the public. Public participation and written comments are invited on all open session business items.
   The Mayor/Chair requests that all electronic devices be turned off or set to vibrate. Members of the audience are requested to step outside the Council Chambers to conduct a phone conversation. Weatherford City Hall is wheelchair accessible and special parking is available on the south side of the building. If special accommodations are required please contact the City Secretary at 817-­598-­4202 a minimum of 24 hours in advance.
   The City Council, Municipal Utility Board, and other boards/commissions/committees of the City of Weatherford, as allowed, reserve the right to enter into Executive Session at any time during the course of this meeting to seek legal advice from the City Attorney on any posted agenda item as authorized by Texas Government Code, Chapter 551.071.
   Unless a Work Session Agenda, or otherwise indicated, action may be taken on any of the following agenda items.

All of the Consent Agenda Items are considered to be routine and self-explanatory and will be enacted with one motion. There will be no separate consideration of these items unless the Council or Board removes the item from Consent.

Consider a request for final plat approval for Chisolm Park Addition Phase 2, being 49 residential lots on a 23.661 acre tract generally located along FM 920 and being situated in the John C. Chapman Survey, Abstract No. 249, City of Weatherford, Parker County, Texas. SBD2024-0007.

Suggested Action:

Staff recommends approval of the final plat for Chisolm Park Addition Phase 2, subject to all requirements of the subdivision ordinance. At their March 13th, 2024, regularly scheduled meeting, the Planning & Zoning Commission voted 4-0 to recommend approval of the final plat subject to the following conditions. 

 

1. Show the limits of the 100-year flood plain on the plat (Refer to WMC §11-5-2(o)).

 

 

2. Show at least 2 concrete monuments set at opposing ends of the property (Refer to EDCM §1.11.4).

 

 

3. Street intersections shall be tangent for at least 50’ (Refer to EDCM §2.4.4).

 

 

4. Public improvements are required to be accepted before the final plat is recorded (Refer to WMC §11-5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (Refer to WMC §11-5-9(c)(2)).

 

 

5. Additional easements and alignments changes may be required after review of the civil plans.

 

 

6. All lots with dimensions shall be provided on a single sheet. (Refer to WMC §11-5-2(f)).

Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-07 regarding a request for a conditional use permit for a Tool and Machinery Rental with outdoor storage use on a 2.368 acre tract located at 1506 and 1430 Fort Worth Highway, said tracts being situated in Sarah Monk Survey Abstract No. 906, City of Weatherford, Parker County, Texas. CUP2024-0001.

Suggested Action:

At their March 13th, 2024, regularly scheduled meeting, the Planning & Zoning Commission voted unanimously 4-0 to recommend approval of the conditional use permit request, subject to the 2 conditions as recommended by staff as provided below. 

 

1. Repair of equipment not owned by Buffalo Rental is prohibited. 

 

2. Hours of operation shall be from 7:00 a.m. to 6:00 p.m., Monday through Sunday.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-09 concerning a request for a Zoning Ordinance Amendment and 1st Amendment to the Development Agreement for Bethel Place, being located at 2552 Bethel Road, City of Weatherford, Parker County, Texas. ZCH2024-0002.

Suggested Action:

At their March 13th, 2024, regularly scheduled meeting, the Planning & Zoning Commission voted 4-0 to recommend approval of the 2023 Weatherford Housing Market Analysis.

Hold a PUBLIC HEARING and consider a request for a conditional use permit for an Electric Vehicle Charger use on a 16.119 acre tract located at 1201 I-20 West (Pilot Travel Center), City of Weatherford, Parker County, Texas. CUP2024-0002.

Suggested Action:

Staff recommends approval of the conditional use permit request subject to conditions.

 

At their March 13th, 2024, regularly scheduled meeting, the Planning & Zoning Commission voted unanimously (4-0) to recommend approval of the conditional use permit request, subject to the conditions as recommended by staff. 

 

1. Canopy and EV chargers must be behind or parallel to existing canopy and pumps.

Residents may address the Council/Board/Commission/Committee regarding an item that is not listed on the agenda. Residents must complete a speaker card and turn it in to the Secretary five (5) minutes before the start of the meeting. The Rules of Procedure states that comments are to be limited to three (3) minutes. Speaker rules are posted at the back of the Council Chambers. The Texas Open Meetings Act provides the following: (a) If, at a meeting of a governmental body, a member of the public or of the governmental body inquires about a subject for which notice has not been given as required by this subchapter, the notice provisions of this subchapter do not apply to: (1) A statement of specific factual information given in response to the inquiry; or (2) A recitation of existing policy in response to the inquiry. (b) Any deliberation of or decision about the subject of the inquiry shall be limited to a proposal to place the subject on the agenda for a subsequent meeting.
